What is the specialized inspection of the People's Public Security Forces in Vietnam?

According to Clause 1, Article 3 of the Draft Circular by the Ministry of Public Security of Vietnam:

"Specialized inspection by the People's Public Security Force" is an inspection activity conducted by the inspection unit of Public Security authorities at different levels with the authority and agencies assigned to perform specialized inspection functions towards organizations, agencies, and individuals in complying with the legal regulations on protecting national security, ensuring social order, and safety within the state management scope of the Ministry of Public Security.

"Re-inspection" is the review, evaluation, and processing of inspection conclusions upon discovering signs of legal violations during the inspection and conclusion issuance process.

The person authorized to issue the inspection decision is regulated as the head of the inspection agency, the head of the agency assigned to perform specialized inspection functions, who is responsible for conducting inspection, signing, issuing the inspection decision, and executing duties and powers as specified in Clause 1, Article 80 of the Law on Inspection 2022.

The person assigned to perform the specialized inspection duties of the People's Public Security Force is the one appointed by the head of the inspection agency, the head of the agency performing specialized inspection functions of the People's Public Security Force to carry out the inspection duties.

Proposed Authority to Issue Inspection Decisions of the People's Public Security Force in Vietnam

The authority to issue inspection decisions is specified in Article 5 of the Draft Circular by the Ministry of Public Security as follows:

(1) Chief Inspector of the Ministry of Public Security of Vietnam issues inspection decisions:

- Fields under the state management scope of the Ministry of Public Security according to the annual inspection work plan approved by the Minister of Public Security;

- Unexpected inspections of Ministries, sectors, corporations, general companies, and companies under the state management scope of the Ministry of Public Security or involving multiple localities and Provincial People's Committees when assigned by the Minister of Public Security or at the request of the Government Inspectorate of Vietnam;

- Re-inspection of cases that have received inspection conclusions from Provincial Police Inspectors, the Fire Prevention, Fighting and Rescue Police Department but show signs of legal violations or involve complex complaints, denunciations affecting multiple levels, sectors, and localities. The re-inspection is conducted according to regulations from Articles 19 to 24 of Decree 43/2023/ND-CP dated June 30, 2023, of the Government of Vietnam.

(2) Director of the Fire Prevention, Fighting and Rescue Police Department issues inspection decisions:

- Organizations, agencies, and individuals in the field of fire prevention, fighting, and rescue under the management scope according to the annual inspection work plan approved by the Minister of Public Security;

- Unexpected inspections when discovering organizations, agencies, individuals with signs of legal violations in fire prevention, fighting, and rescue under management; cases assigned by the Minister of Public Security or at the request of the Inspectorate of the Ministry of Public Security.

(3) Chief Inspector of the Provincial Public Security issues inspection decisions:

- Organizations, agencies, and individuals under the state management scope of the Provincial Public Security according to the annual inspection work plan approved by the Minister of Public Security;

- Unexpected inspections of provincial departments and authorities, District People's Committees, enterprises, organizations, individuals in the managed area when discovering signs of legal violations; as required for resolving complaints, denunciations, corruption prevention, and complex negative issues under the management scope of the Provincial Public Security; cases assigned by the Provincial Public Security Director or at the request of the Inspectorate of the Ministry of Public Security.
