On August 28, 2020, the Government of Vietnam issued Decree 101/2020/ND-CP amending a number of provisions of Decree 123/2016/ND-CP on the functions, tasks, powers, and organizational structure of ministries and ministerial agencies.
What is the number of deputy heads for each department upon establishment under the law in Vietnam? (Illustrative image)
According to Clause 3, Article 18a of Decree 101/2020/ND-CP, which supplements new regulations, the number of deputy heads of the head of the department in Vietnam is as follows:
- Departments under the General Department under the Ministry with 07 to 09 official staff members can have 01 deputy head; with 10 to 15 official staff members, up to 02 deputy heads can be appointed; with 16 or more official staff members, up to 03 deputy heads can be appointed;
- Departments under sub-departments under the General Department under the Ministry with 05 to 07 official staff members can have 01 deputy head; with 08 or more official staff members, up to 02 deputy heads can be appointed.
Regarding the implementation methods and the specific number of deputy heads:
- The number of deputy heads of the head of the department under the inspectorate, office, and divisions under the Ministry, and the department under the office and the General Department under the Ministry is implemented according to the regulations on the number of deputy heads of the head of the department under the General Department under the Ministry.
- The number of deputy heads of the head of the department under the sub-department under the General Department under the Ministry is implemented according to the regulations on the number of deputy heads of the head of the department under the sub-department under the General Department under the Ministry.
Through the above regulations, it can be seen that the Government of Vietnam regulates the maximum number of deputy heads of the heads of divisions, offices, inspectorates, General Departments, and public service providers, but ensuring an average of no more than 03 people per unit. This is to maximize the efficiency in State management, avoiding excessive decentralization and delegation.
