What is a judicial record certificate and what types of judicial record certificates are there?
Judicial record card is a card issued by the judicial record database managing agency, which has the value to certify whether an individual has a criminal record or not; whether the individual is banned or not from holding positions, establishing, or managing enterprises, cooperatives in case the enterprise or cooperative is declared bankrupt by the Court (Based on Clause 4, Article 2 of the 2009 Law on Judicial Records)
Judicial record card
There are 2 types of judicial record cards as stipulated in Article 41 of the 2009 Law on Judicial Records, which are: Judicial record card No. 1 and Judicial record card No. 2.
Judicial record card No. 1 is issued to the following subjects:
- Vietnamese citizens, foreigners who have resided or are residing in Vietnam.- State agencies, political organizations, socio-political organizations: To serve the management of personnel, business registration activities, establishment, and management of enterprises, cooperatives.
Judicial record card No. 2 is issued to the following subjects:
- At the request of the proceeding-conducting agencies: To serve the work of investigation, prosecution, and trial as stipulated in Clause 2, Article 7 of the Law on Judicial Records; and- At the request of individuals: To allow the individual to know the contents of their judicial record.
