What is the function of the Occupational Safety and Protection Agency under the Ministry of National Defense?

The Ministry of National Defense issued Circular 142/2017/TT-BQP on May 29, 2017, specifically stipulating the functions, tasks, and powers of the Occupational Safety and Health Agency under the Ministry of National Defense.

Circular 142 stipulates that the Safety and Labor Protection Agency of the Ministry of National Defense has the function of advising the Chief of the General Department of Technical Assistance and assisting the Minister of National Defense in performing the state management function regarding safety and labor hygiene within the Ministry of National Defense. It organizes, manages, directs, guides, inspects, supervises, and urges the implementation of all aspects of safety and labor hygiene work throughout the military as prescribed by law and the Ministry of National Defense.

Additionally, Circular 142 also stipulates the tasks and powers of the Safety and Labor Protection Agency of the Ministry of National Defense as follows:

- Propose to the Chief of the General Department of Technical Assistance to submit to the Minister of National Defense the policies, measures, programs, and short-term, medium-term, and long-term plans regarding safety and labor hygiene work within the Ministry of National Defense and organize their implementation as prescribed;- Develop and report to the Chief of the General Department of Technical Assistance to submit to the Minister of National Defense for issuing legal documents, administrative documents to direct and manage work on safety, labor hygiene, fire, and explosion prevention; lists of machines, equipment, materials, and substances with special military specifications requiring strict labor safety measures and organize their implementation as prescribed;- Propose research and apply labor protection science and technology to prevent hazardous and harmful factors; improve working conditions to minimize labor accidents and occupational diseases in production, exploitation, management, and technical weaponry equipment within military units;- Organize investigations into serious labor accidents and fire and explosion incidents according to the regulations of the Ministry of National Defense; periodically compile, analyze, and notify the entire military to draw lessons from labor accidents, fire, and explosion incidents and direct preventive and mitigation solutions;- Direct and guide agencies and units in organizing the implementation of safety and labor hygiene work, providing personal protective equipment; fire and explosion prevention, electrical safety, and lightning protection at technical facilities; registration, technical safety inspection of machines, equipment, materials, and substances requiring strict labor safety; training, propagating about safety and labor hygiene work; reporting work on labor accidents and fire and explosion incidents;- Preside over and cooperate with relevant agencies to determine the list of heavy, hazardous, and dangerous occupations; the list of occupational diseases in the military field to propose to competent authorities for approval and organize their implementation;- Organize to inspect the compliance with labor law regulations; safety and labor hygiene; fire and explosion prevention; labor protection for units within the Ministry of National Defense (including foreign organizations and individuals employing labor or directly working within the Ministry of National Defense). Decide to temporarily suspend the use of machines, equipment, workplaces that pose a risk of safety loss, labor accidents, serious environmental pollution in labor, report to competent authorities for processing. Participate in delegations led by the Inspectorate of the Ministry of National Defense to carry out specialized safety, labor hygiene inspections;- Coordinate with functional agencies to inspect and examine the implementation of safety and labor hygiene work, labor environment conditions. Appraise technical safety; appraise according to the law and the Ministry of National Defense's regulations the compliance with safety standards and measures, economic and technical justifications, project designs for new construction or expansion, renovation of facilities for production, exploitation, storage, and preservation of machines, equipment, materials, and substances requiring strict labor safety;- Handle or propose competent authorities to handle violations of safety and labor hygiene laws and labor protection according to the Ministry of National Defense's division. Review and propose competent authorities to resolve disputes, complaints about violations of safety, labor hygiene, and labor protection regulations. Propose to competent authorities to develop, amend, supplement policies, laws regarding labor accidents and occupational diseases;- Manage technical safety inspection work on machines, equipment, materials, and substances requiring strict labor safety within the Ministry of National Defense according to the law and Ministry of National Defense's regulations. Direct the Army Technical Safety Inspection Center to carry out technical safety inspections on machines, equipment, materials, and substances requiring strict labor safety and other assigned duties;- Compile and propose the allocation of the labor protection budget and personal protective equipment in labor at units under the Ministry of National Defense and organize their implementation when approved;- Manage safety and labor hygiene training work within the Ministry of National Defense. Organize training, retraining, and professional development on safety and labor hygiene for officers and staff engaged in safety and labor hygiene work; summarize and evaluate all aspects of safety and labor hygiene work; propose and submit to competent authorities for rewarding safety labor protection work for units throughout the military;- Advise the Chief of the General Department of Technical Assistance and Minister of National Defense in working with state agencies, international organizations on general safety and labor hygiene work and specific military safety, labor hygiene work;- Perform other duties assigned by the Minister of National Defense and the Chief of the General Department of Technical Assistance.
