What is a State Agency?

State agencies have the following characteristics:

- Exercising state authority;- Acting on behalf of the state to exercise state authority;- Within their jurisdiction, state agencies have the authority to issue legal normative documents or documents applying laws;- Supervising the implementation of the documents they issue;- Having the authority to enforce compulsory measures when necessary;- The jurisdiction of state agencies has limitations in terms of space (territory), effective time, and the subjects under influence. The jurisdiction of an agency depends on its legal status within the state apparatus. The jurisdictional limits of a state agency are legal limits as defined by law;- Each state agency has its own forms and methods of operation as prescribed by law.

Classification of State Agencies:

- Based on the manner of exercising authority:- State power agencies: The National Assembly is the highest power agency; The People's Council is the local power agency;- State administrative agencies: the Government of Vietnam, ministries, ministerial-level agencies, government-attached agencies, People's Committees at the provincial and district levels, and specialized agencies under the People's Committees.- Judicial agencies: Courts, Procuracies;- Based on the process of establishment:- State agencies elected by the people;- State agencies not elected by the people;- Based on the nature of authority:- State agencies with general authority;- State agencies with specialized authority;- Based on levels of authority:- Central state agencies;- Local state agencies
