This is an important provision specified in Circular 66/2011/TT-BCA stipulating the formulation, promulgation, inspection, and handling of legislative documents in the People's Police Force issued by the Ministry of Public Security of Vietnam on October 03, 2011.
What is a legislative document on the protection of security and order in Vietnam? (Internet image)
At Article 2 of Circular 66/2011/TT-BCA, regulations on legislative documents in the field of protecting national security, maintaining order, and social safety in Vietnam are as follows:
- Legislative documents in the field of protecting national security, maintaining order, and social safety (hereinafter collectively referred to as protection of security and order) are documents issued by state agencies or authorized individuals in accordance with the forms, procedures, and processes stipulated in the Law on Promulgation of Legislative documents dated June 3, 2008 (hereinafter collectively referred to as the Law on Promulgation of Legislative documents), Decree No. 24/2009/ND-CP dated March 5, 2009, of the Government of Vietnam detailing and providing measures for the implementation of the Law on Promulgation of Legislative documents (Decree No. 24/2009/ND-CP), and other related legislative documents; these documents contain general rules of conduct, are applied repeatedly to all or a group of entities, and are effective nationwide or in individual localities; the State ensures their implementation through measures prescribed by law.
- Documents issued by agencies or authorized individuals in the People's Public Security that do not fully meet the criteria of a legislative document as stipulated in Clause 1 of this Article, such as:
- Decisions approving programs, proposals, projects;
- Decisions regulating internal operations of the agencies or units; directives initiating emulation movements;
- Decisions, directives for administrative guidance, management, overseeing the implementation of laws, and legislative documents;
- Decisions on promotion, salary increment, appointment, relief, reassignment, commendation, and discipline;
- Decisions on administrative sanctions and other individual documents to resolve specific cases, for specific subjects, are not considered legislative documents.
