What does application for appraisal and establishment of public service providers in Vietnam? (Illustrative image)

According to Article 11 of Decree 120/2020/ND-CP, the application for appraisal and establishment in Vietnam is regulated as follows:

1. The application sent to the appraisal agency or organization in Vietnam includes:

- A written request for appraisal signed and sealed by the proposing agency or organization in accordance with regulations;

- Draft proposal for establishing the public service provider;

- Draft plan for establishing the public service provider;

- Draft document of the agency or person authorized to decide the establishment of the public service provider; draft regulations on the organization and operation of the public service provider and other related documents (land documents, funds, human resources);

- Written opinions from relevant agencies and organizations regarding the establishment of the public service provider;

- Report from the proposing agency or organization on the receipt and explanation of opinions from relevant agencies and organizations;

- Other contents as stipulated by specialized law and guidance from the sector management ministry.

2. The application submitted to the agency or person authorized to decide the establishment of the public service provider in Vietnam includes:

- Proposal from the agency or organization proposing the establishment of the public service provider;

- Plan for establishing the public service provider;

- Draft document of the agency or person authorized to decide the establishment of the public service provider; draft regulations on the organization and operation of the public service provider and other related documents (land documents, funds, human resources);

- Appraisal document from the authorized agency or organization;

- Report from the proposing agency or organization on the receipt and explanation of opinions from the appraisal agency or organization;

- Report from the proposing agency or organization on the receipt and explanation of opinions from relevant agencies and organizations (attached with written opinions from these bodies) and other related documents regarding the establishment of the public service provider;

- Other contents as stipulated by specialized law and guidance from the sector management ministry in Vietnam.

More details can be found in Decree 120/2020/ND-CP, which comes into force in Vietnam from December 01, 2020.
