Regarding this issue, LawNet would like to answer as follows:
On August 2, 2023, the Minister of Public Security of Vietnam issued Circular 36/2023/TT-BCA regulating the process of patrolling, controlling and handling administrative violations of the Waterway Police.
According to Clause 1, Article 5 of Circular 36/2023/TT-BCA, types of patrol and control plans on waterways include:
(1) Plan for general control and handling of violations;
(2) Peak patrol plan, control, and handling of violations;
(3) Regular, periodic, or unexpected patrol and control plans;
(4) Plan for patrolling, controlling, and handling violations by topic;
(5) Plan to coordinate with relevant units to ensure the order and safety of waterway traffic, security, and order;
(6) Weekly work plan; patrol and control plan for the Waterway Police Group.
Thus, there are 6 types of patrol and control plans on waterways.
Specifically, Article 6 of Circular 36/2023/TT-BCA stipulates the authority to issue patrol and control plans on waterways in Vietnam as follows:
- The Minister of Public Security promulgates a plan to patrol, control, and handle violations on waterways nationwide.
- Director of the Traffic Police Department shall:
+ Advise the Minister of Public Security to promulgate plans to patrol, control, and handle violations on waterways nationwide;
+ Directly issue plans to patrol, control, and handle violations on waterways by route, area, or nationwide;
+ Direct, guide, inspect, and urge the implementation of promulgated plans for patrolling, controlling, and handling violations.
- Director of Police of provinces and centrally run cities (hereinafter referred to as the Director of Provincial Police) shall:
+ Issue plans to patrol, control, and handle violations within the scope of management;
+ Direct, guide, inspect, and urge the work of patrolling, controlling, and handling violations within the scope of management;
+ Direct and coordinate with the patrol and control forces of the Traffic Police Department when required.
- Head of the Department of Guidance on Patrolling, Controlling, and fighting against crime on inland waterways shall:
+ Advise the Director of the Traffic Police Department to promulgate plans to patrol, control, and handle violations under the authority of the Traffic Police Department;
+ Directly direct, guide, inspect, and urge the implementation of patrol, control, and violation handling plans of the Ministry of Public Security and the Traffic Police Department.
- Crew chief of the Traffic Police Department; Head of the Waterway Police Department, Head of the Traffic Police Department (hereinafter referred to as Head of the Traffic Police Department); Chief of Police of a district, town, or provincial city; Chief of Police of a district, district, or city of a centrally run city (hereinafter referred to as Chief of District Police):
+ Develop plans to organize patrols, control, and handle violations regularly, monthly or irregularly on assigned routes and areas;
+ Approve weekly work plans of affiliated Teams, Stations, and Fleets.
- Captain, Station Commander, Fleet Commander shall:
+ Advise the Crew Chief; Head of Traffic Police Department; The District Police Chief performs the tasks specified in Point a, Clause 5, Article 6 of Circular 36/2023/TT-BCA;
+ Make weekly work plans and report to the Crew Chief; Head of Traffic Police Department; The District Police Chief or deputy assigned to be in charge of approval;
+ Based on the approved weekly work plan, schedule the implementation of the weekly work plan for each patrol and control group;
+ Assign tasks to each member of the patrol and control team in the waterway patrol and control planning book and diary;
+ Only one plan can be made for one patrol and control group; Once the plan is completed, the next implementation plan can be made.
- Head of Commune, Ward and Town Police (hereinafter abbreviated as Head of Commune Police) approves plans to ensure security and order in the area to carry out the work of ensuring order, traffic safety, and order for people and vehicles at river-crossing passenger wharves and unannounced waterways within the commune-level administrative boundaries.
Circular 36/2023/TT-BCA takes effect on September 16, 2023, and replaces Circular 68/2020/TT-BCA, dated June 19, 2020.
