What are the responsibilities of heads of scientific experiment, research facilities in Vietnam from September 15, 2019?

Recently, the Ministry of Science and Technology of Vietnam has issued the Circular No. 04/2019/TT-BKHCN on use of chemicals for scientific experiments and research.

Head of scientific experiment, research facility (i.e. the legal representative of the scientific experiment, research facility) shall have the responsibilities listed in Article 8 of Circular No. 04/2019/TT-BKHCN of the Ministry of Science and Technology of Vietnam, specifically as follows:

- implement chemical management and chemical safety management as per law.

- develop, approve and issue the regulations, procedures and guidelines on the safe use of chemicals in accordance with regulations and law.

- construct the chemical storage and laboratories satisfactory to the national technical standards and regulations, the technical facility requirements, the specialized characteristics, the scale and dangerous properties of the used chemicals.

- fully allocate the personnel, safety equipment, the personal protective equipment and assign persons to monitor chemical safety, to manage, store and handle chemical incidents.

- ensure safety conditions for human and environment during the storage and use of chemicals for the scientific experiments and research as per law.

- develop the chemical incident response and prevention plans and measures as set forth under the Law on Chemicals and Decree No. 113/2017/ND-CP.

- organize the training relating chemical safety or assign persons to participate in the training courses of the chemical safety course organizers as specified in Decree No. 113/2017/ND-CP.

- organize the activities ensuring safe chemical use, including:

+ Publicized, instruct the chemical users to acknowledge the regulations on safe chemical use, the procedures for conducting the scientific experiments and research and the ability to safely handle incidents in their workplace;

+ Fully and appropriately provide and maintain the safety equipment and personal protective equipment to ensure a safe working environment;

+ Allocate the safety equipment neatly, visibly, accessibly and thoroughly.

- strictly manage and control, accurately and promptly report on the use of banned chemicals to the competent regulatory agencies.

- prepare the chemical records and archive the material Safety Data Sheet as per law.

- examine and inspect the safety equipment according to measurement laws.

- handle and dispose of stagnated chemicals, wastes and chemical containers as set forth under Article 35 of the Law on Chemicals of Vietnam.
