What are the regulations on payrolls for apprentices who are public employees in Vietnam?

This is the main content stipulated in Decree 115/2020/ND-CP of the Government on the recruitment, use, and management of public employees, issued on September 25, 2020.

According to Decree 115/2020/ND-CP, the salary for apprentices who are public employees in Vietnam is regulated as follows:

1. During the probationary period, the probationary employee is entitled to 85% of the first-grade salary of the recruited professional title. If the probationary employee has a master's degree relevant to the job position requirements, he/she is entitled to 85% of the second-grade salary of the recruited professional title; if the probationary employee has a doctorate degree relevant to the job position requirements, he/she is entitled to 85% of the third-grade salary of the recruited professional title. They are also entitled to allowances as prescribed by law.

2. The probationary employee is entitled to 100% salary and allowances of the professional title corresponding to the educational level stipulated in Clause 1 of this Article in the following cases:

  • Working in areas with extremely difficult socio-economic conditions;
  • Working in hazardous or dangerous sectors and professions;
  • Completing military service; participation in the people's police; army officers, police officers, professional military personnel discharged, individuals in cryptographic work changing sectors, graduates of reserve officer training, local military commander training being appointed as reserve officers, registered as reserve officers grade, members of youth volunteer teams, intellectual youth volunteers participating in rural and mountainous development for at least 24 months completing their duties.

3. The probationary period is not counted towards the time for salary grade promotion consideration.

4. The mentor guiding the probationary employee is entitled to a responsibility allowance coefficient of 0.3 of the base salary during the mentoring period.

5. During the probationary period, the mentor and the probationary employee are also entitled to other reward and welfare benefits (if any) as prescribed by the State and the regulations of public non-business units.
