What are the Procedures for Dissolution of Youth Volunteer Organizations in Vietnam?

Recently, the Ministry of Home Affairs issued Circular 11/2011/TT-BNV guiding Decree 12/2011/ND-CP on the organization and policies for youth volunteers in Vietnam.

What are the Procedures for Dissolution of Youth Volunteer Organizations in Vietnam? (Internet image)

The order and procedures for the dissolution of the youth volunteer organization in Vietnam as stipulated in Clauses 1 and 2 of Article 6 Circular 11/2011/TT-BNV are carried out as follows:

- The authority with the competence to dissolve the youth volunteer organization shall prepare one dossier as prescribed in Article 9 of this Circular and submit it directly to the competent state management agency for review and approval or disapproval of the dissolution;

- Within ten working days from the date of receipt of a complete and valid dossier, the competent state management agency shall review and provide a written opinion on the approval of the dissolution of the youth volunteer organization. In case of disapproval, specific reasons must be stated;

- Within five working days from the date of receipt of the approval opinion from the competent state management agency, the competent authority shall issue the decision to dissolve the youth volunteer organization.

In the case of dissolving Centers or Institutions for Social Labor Education, after obtaining approval from the competent state management agency, the order and procedures for dissolution shall comply with the provisions of the law related to sector-specific activities.

2. The order and procedures for the dissolution of the youth volunteer organization as stipulated in Clause 3 of Article 6 of Circular 11/2011/TT-BNV are carried out as follows:

- Based on the decision to handle violations by the competent authority, the competent authority shall directly send the dossier to the competent state management agency for approval of the dissolution;

- Within ten working days from the date of receipt of a complete and valid dossier, the competent state management agency shall review and provide a written opinion on the approval of the dissolution of the youth volunteer organization;

- Within five working days from the date of receipt of the approval opinion from the competent state management agency, the competent authority shall issue the decision to dissolve the youth volunteer organization.

More details can be found in Circular 11/2011/TT-BNV, which comes into effect in Vietnam from November 1, 2011.
