What are the Penalties for "Random" Advertising?

Advertisement is a form of marketing for goods and services that many individuals, organizations, and businesses choose to attract consumers to their products. Advertising activities can be carried out in various forms, such as posting information on media platforms, hanging signs, banners, etc. However, the choice of advertising forms must ensure cultural values and comply with legal regulations.

In reality, we frequently encounter images of promotional flyers haphazardly pasted or some images directly drawn on walls and utility poles in public places. These actions mar the aesthetic image of urban areas and violate legal regulations.

2012 Advertising Law strictly prohibits the following acts: advertising that affects urban aesthetics, public order, traffic safety, social safety, and hanging, placing, pasting, or drawing promotional materials on utility poles, electric poles, traffic signal poles, and public green trees.

Decree 158/2013/ND-CP stipulates penalties for violations in advertising activities as follows:

- A fine ranging from 1,000,000 VND to 2,000,000 VND for the act of hanging, placing, pasting, or drawing promotional materials on utility poles, electric poles, traffic signal poles, and public green trees.- A fine ranging from 10,000,000 VND to 20,000,000 VND for the act of advertising that affects aesthetics, public order, traffic safety, and social safety.

In addition to administrative penalties for the act of improperly placing promotional posters and flyers, the perpetrator must also implement measures to remedy the consequences, such as being required to remove or erase the advertisements.

Though the regulations stipulate a "prohibition," the issue of indiscriminate advertising is rampant in many large cities such as Ho Chi Minh City, Hanoi, etc. It appears that the fines imposed for indiscriminate advertising are insufficient to deter people's awareness.
