What are regulations on schools of the Vietnam People's Armed Forces?

On December 30, 2011, the Government of Vietnam issued Decree 125/2011/ND-CP regulating schools under state agencies, political organizations, socio-political organizations, and the Vietnam people's armed forces.

What are regulations on schools of the Vietnam People's Armed Forces? (Illustrative image)

According to Decree 125/2011/ND-CP on the regulation of schools of the Vietnam People's Armed Forces, as follows:

1. Position of training and fostering schools

- Training and fostering schools of political organizations are public service providers under the Central Committee of the Communist Party and the Government of Vietnam; the Party Committee and People's Committee of provinces, centrally-run cities; district, town, and district-level city Party Committees and People's Committees.

- Training and fostering schools of state agencies are public service providers under Ministries, Ministerial-level agencies, Governmental agencies; the Supreme People's Procuracy; the Supreme People's Court; the State Audit.

- Training and fostering schools of socio-political organizations are public service providers under the Central bodies of such socio-political organizations.

- Training and fostering schools of the Vietnam People's Armed Forces are military organizations under the various management levels of the Ministry of National Defense, Ministry of Public Security.

2. Duties and powers of training and fostering schools

Training and fostering schools have the following duties and powers:

- Organize teaching, learning, and other activities according to objectives, training, and fostering programs assigned by competent authorities; issue diplomas and certificates as stipulated.

- Organize scientific research; summarize practical experiences, research, develop theoretical foundations serving the strategic planning of the Communist Party, state policies; participate in solving local and national socio-economic, defense, and security issues.

- Exercise autonomy and accountability as prescribed by law.

- Other duties and powers as specified by the head of the direct superior agency or the Chief of Management Agency (for the armed forces) of the school as prescribed by law.

The head of the direct superior agency or the Chief of Management Agency (for the armed forces) of the training and fostering school specifically prescribes the duties and powers of the training and fostering school.

3. Organization and activities

- The organizational structure of training and fostering schools includes: the Principal, Vice Principals (or Director, Deputy Directors), and functional departments, including: faculties, specialized departments; advisory departments, institutes, centers; units serving training and scientific research.

- The head of the direct superior agency or the Chief of Management Agency (for the armed forces) of the training and fostering school specifies the organization and the number of personnel according to job positions or staffing levels of the school.

In special cases, the organization and the number of personnel according to job positions or staffing levels of the training and fostering school are prescribed by the Government of Vietnam or the competent authority of the Communist Party of Vietnam.

- Training and fostering schools operate according to internal regulations on organization and activities, internal revenue and expenditure regulations issued by the Principal (or Director) of the training and fostering school based on the provisions of this Decree and relevant laws.
