The following article concerns the consolidation of legislative documents by the Ministry of Construction of Vietnam as stipulated in Decision 101/QD-BXD of 2025.

On January 24, 2025, the Minister of Construction issued Decision 101/QD-BXD regarding the Regulation on drafting and promulgating legislative documents within the scope of state management functions of the Ministry of Construction.

What are regulations on consolidation of legislative documents by the Ministry of Construction of Vietnam?

According to the provisions at Article 45 of the Regulation issued together with Decision 101/QD-BXD in 2025, the consolidation of legislative documents by the Ministry of Construction is carried out as follows:

- Documents amending and supplementing certain articles of legislative documents must be technically consolidated with the amended and supplemented document.

- The head of the specialized unit of the Ministry is responsible for organizing the consolidation of legislative documents for documents drafted by their unit when amended and supplemented. The consolidated document must ensure accuracy in content, consolidation technique, and must be submitted for the Minister's authentication in accordance with the timeline specified in Clause 3, Article 6, and Clause 5, Article 7 of the Ordinance on Consolidation of Legislative Documents 2012.

Article 6. Authority and time limit for document consolidation by the President of State, the Government of Vietnam, the Prime Minister of the Government of Vietnam, inter-ministerial documents between the Government of Vietnam and the central agencies of social-political organizations

3. No later than 5 working days from the date of receipt of the document as prescribed in Clause 2 of this Article, the head of the agency presiding over the drafting of the amended and supplemented document must complete the consolidation and authenticate the consolidated document.

 

Article 7. Authority and time limit for document consolidation by other State agencies

5. No later than 5 working days from the date of signing and promulgating the document, the authorized person as stipulated in Clauses 1, 2, 3, and 4 of this Article must complete the consolidation and authenticate the consolidated document.”

+ For legislative documents of the Government of Vietnam, the Prime Minister of the Government of Vietnam: no later than 5 working days from the date of receipt of the amended and supplemented document sent by the Government Office, the presiding unit is responsible for completing the consolidation and submitting it to the Minister for authentication.

+ For circulars/joint circulars: no later than 5 working days from the date of signing and promulgating, the presiding unit is responsible for completing the consolidation and submitting it to the Minister for authentication.

- After completing the consolidation of legislative documents, the presiding unit is responsible for publishing and updating the consolidated document in accordance with the provisions at Section 4, Chapter III of the Regulation issued together with Decision 101/QD-BXD in 2025.

Note: legislative documents issued by the Minister of Construction or submitted to competent authorities for issuance as provided for in the Regulation issued together with Decision 101/QD-BXD in 2025 include:

- Laws, resolutions of the National Assembly; ordinances, resolutions of the Standing Committee of the National Assembly; joint resolutions between the Standing Committee of the National Assembly, the Government of Vietnam, and the Presidium of the Central Committee of the Vietnam Fatherland Front; joint resolutions between the Government of Vietnam and the Presidium of the Central Committee of the Vietnam Fatherland Front; orders, decisions of the President (assigned by the Government of Vietnam and Prime Minister for drafting).

- Decrees of the Government of Vietnam;

- Decisions of the Prime Minister of the Government of Vietnam;

- Circulars by the Minister of Construction; joint circulars between the Minister of Construction and the Chief Justice of the Supreme People's Court, the Head of the Supreme People's Procuracy, and the General Auditor of the State.
