This is the content in Decree 221/2013/ND-CP stipulating policies on administrative measures applied to rehabilitation centers in Vietnam.
What are regulations on addict management before sending to the rehabilitation centers in Vietnam?
According to Article 14 of Decree 221/2013/ND-CP, which stipulates that social organizations are responsible for managing persons without stable places of residence during the procedures for applying measures to send them to rehabilitation centers, specifically:
+ Regarding infrastructure and equipment: the center must be built as an integrated complex, isolated from the external environment to prevent drug infiltration. It must have at least three functional rooms and accompanying equipment as follows:
- Examination and emergency room: minimum area of 10 m² with a medicine cabinet containing all necessary medicines and emergency equipment as prescribed by the Ministry of Health;
- Patient room: minimum area of 8 m² and at least 4 m² per patient; each patient must have a set of living supplies, including a bed, mat, sheet, pillow, blanket, and mosquito net;
- Permanent staff room for medical staff and security personnel;
+ Regarding personnel, there must be a minimum of four persons, including: the director of the detoxification treatment unit must be a psychiatrist or general practitioner with a practice certificate as per the Law on Medical Examination and Treatment and a training certificate in drug detoxification treatment; one physician; one nurse; and one security guard.
Social organizations are responsible for managing persons proposed for measures sending them to rehabilitation centers during the procedural period according to the regulations in Article 131 of the Law on Handling Administrative Violations and supporting drug detoxification treatment as regulated by the Ministry of Health.
Social organizations participating in the management as stated in Clause 2 of this Article are supported financially during the management of persons proposed for measures sending them to rehabilitation centers. This includes direct support for the social organization staff assigned to manage and assist the addict; support for food, medicine, and other living expenses for the addict.
The Ministry of Finance, in cooperation with the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Health, and the Ministry of Home Affairs, shall guide the conditions to ensure the organization of managing persons without stable places of residence during the dossier preparation period proposing measures for compulsory rehabilitation.
