What are penalties for violations against regulations on cosmetics trading in cosmetics business in Vietnam? (Illustrative image)
Article 71 Decree 117/2020/ND-CP stipulates administrative penalties for violations against regulations on the cosmetics trading in cosmetics business as follows:
1. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed when the total value of the violating batch is below VND 20,000,000, or from VND 10,000,000 to VND 20,000,000 when the total value of the violating batch is from VND 20,000,000 or higher based on the selling price, for organizations or individuals not responsible for placing the product on the market, committing one of the following acts:
- Trading cosmetics with packaging that is no longer intact from the manufacturer;
- Trading cosmetics that are expired or beyond the recommended period by the manufacturer;
- Trading cosmetics that have been announced for recall by competent state authorities due to legal violations.
2. A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed on organizations or individuals responsible for placing products on the market committing one of the following acts:
- Trading cosmetics that do not ensure quality or safety for users;
- Trading cosmetics with packaging that is no longer intact from the manufacturer;
- Trading cosmetics that are expired or beyond the recommended period by the manufacturer;
- Trading cosmetics that have been announced for recall by competent state authorities due to legal violations.
3. A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed on organizations or individuals responsible for placing products on the market committing one of the following acts:
- Trading cosmetics containing prohibited substances or exceeding permissible concentration limits according to legal regulations;
- Trading cosmetics without a Product Information File (PIF) or with an incomplete PIF as per legal regulations, or failing to present the PIF when requested by competent authorities;
- Trading cosmetics with a formula that does not match the approved registration dossier;
- Failing to recall cosmetics as requested by competent state authorities.
