What are officials and public employees allowed to participate in decision-making within the agency?

On January 09, 2015, the Government of Vietnam officially issued Decree 04/2015/ND-CP regulating the implementation of democracy in the activities of state administrative agencies and public service providers.

Decree 04/2015/ND-CP lists in detail the matters on which officials and public employees are allowed to provide input, and decisions made by the head of the agency or unit, as specified below:

- Policies and solutions for implementing the resolutions of the Communist Party, and the laws of the State related to the work of the agency or unit.

- The annual work plan of the agency or unit.

- Organization of emulation movements within the agency or unit.

- Mid-term and final reports of the agency or unit.

- Measures to improve the organization, activities, and working styles; prevention and control of corruption; practice of thrift, anti-wastefulness, anti-bureaucracy, and harassment of the people.

- Recruitment, training, and fostering plans for officials and public employees; election, and appointment of officials and public employees.

- Implementation of policies related to the rights and interests of officials and public employees.

- The internal regulations and rules of the agency or unit.

Based on the characteristics, nature of activities, and content of feedback, agencies and units shall apply one of the following three forms of feedback:

- Officials and public employees provide direct feedback or feedback through their representatives to the head of the agency or unit.- Through meetings of officials and public employees of the agency or unit.- Directly issuing opinion polls, sending draft documents for officials and public employees to provide feedback.
