On December 8, 2022, the Government of Vietnam issued Decree 101/2022/ND-CP setting requirements for investment and trading in military uniforms, military equipment and supplies for the people's armed forces, military weapons, specialized technical equipment and technology used for production thereof to ensure national defense and security.

1. What are military uniform and military equipment?

According to Clauses 1 and 2, Article 3 of Decree 101/2022/ND-CP, military uniform and military equipment are prescribed as follows:

- Military uniform includes:

+ Military badges, insignia, ranks and uniforms prescribed in Decree 82/2016/ND-CP;

+ Police badges, insignia, ranks and uniforms prescribed in Decree 160/2007/ND-CP and Decree 29/2016/ND-CP;

+ Coast Guard badges, insignia, service uniforms, dress uniforms, Vietnam Coast Guard flag prescribed in Decree 61/2019/ND-CP;

+ Uniforms, star hat pins and badges of Vietnam Self-Defence Militia prescribed in Decree 72/2020/ND-CP.

- Military equipment are equipment and instruments (except for those prescribed in clause 3 and clause 4 of Article 3 of Decree 101/2022/ND-CP) which are manufactured according to technical standards, designs and use prescribed by the Ministry of National Defense and the Ministry of Public Security to serve regular activities, training, picnics, and ensure combat readiness and combat of the people's armed forces

2. Rules for investment and trading in military uniforms, military equipment in Vietnam

Article 4 of Decree 101/2022/ND-CP stipulates the rules for investment and trading in military uniforms, military equipment and supplies for the people's armed forces, military weapons, specialized technical equipment and technology used for production thereof in service of national defense and security as follows:

- Protect the independence, sovereignty, unity and territorial integrity of the Fatherland, national security as well as social order and safety.

- Strictly control and guard secrets and ensure safety.

- Providers of training, study, manufacture, repair, assembly and development services of military uniforms, military equipment, supplies used for the people’s armed forces, military weapons, specialized technical equipment and technology under the Ministry of National Defense and the Ministry of Public Security only may carry out the study, manufacture, repair, assembly and development when being commissioned or ordered by the competent authorities prescribed in Article 10 of Decree 101/2022/ND-CP.

- Comply with security and order provisions of law on conditional business lines according to regulations in Decree 96/2016/ND-CP; regulations of law on environmental protection.

3. Powers to permit investment and trading in military uniforms, military equipment in Vietnam

Pursuant to Article 10 of Decree 101/2022/ND-CP, the authority to permit investment and trading in military equipment, military equipment, military weapons, technical equipment and specialized technology in service of national defense and security is specified as follows:

- The Prime Minister shall make a decision on permitting the organizations and enterprises prescribed in clause 2 Article 7 of Decree 101/2022/ND-CP to participate in research, manufacture and repair of military weapons in service of national defense and security at the request of the Minister of National Defense or the Minister of Public Security.

- The Minister of National Defense and the Minister of Public Security shall:

+ Commission or order military uniforms, military equipment and supplies for the people's armed forces, military weapons, specialized technical equipment and technology for manufacture and supply thereof;

+ Select contractors for manufacture and supply of military uniforms, military equipment and supplies for the people's armed forces, military weapons, specialized technical equipment and technology;

+ Request the Prime Minister to make a decision on permitting the organizations and enterprises prescribed in clause 2 Article 7 of Decree 101/2022/ND-CP to participate in research, manufacture and repair of military weapons.

Decree 101/2022/ND-CP takes effect from January 30, 2023.
