According to the Draft Circular by the Minister of Public Security of Vietnam, it stipulates legal activities related to drugs for the purposes of national defense and security.
This Circular prescribes legal activities related to drugs for the purposes of national defense and security, including: research, production, import, export, transportation of narcotic substances, precursors; import, sampling, preservation, distribution, use, processing of drug samples; authority to grant permits, units conducting these activities; documentation, management records, and forms used in legal activities related to drugs for the purposes of national defense and security.
Legal activities related to drugs for national defense and security purposes in Vietnam are lawful drug-related activities of competent authorities serving the investigation, prosecution, and adjudication of drug-related criminal cases; tracing drug origins; crime prevention training concerning drug crimes; training of working animals to detect narcotic substances within the Public Security, Army, and Customs forces.
A drug sample is a specimen of narcotic substances, precursors; addictive drugs; psychotropic drugs; pre-substance drugs; pharmaceutical ingredients that are addictive, psychotropic, precursors used in drugs, and veterinary drugs containing narcotics, precursors.
Drug sampling is the activity of collecting and extracting drug samples by authorized units to serve legal activities related to drugs for the purposes of national defense and security.
Researching drugs, precursors for the purposes of national defense and security is the activity of learning, observing, experimenting, and so on, based on the collected documents and data to demonstrate, discover the nature, common rules, or new models that have practical significance related to narcotic substances, precursors by authorized units, individuals for the purposes of national defense and security.
Importing, exporting narcotic substances, precursors, and drug samples for the purposes of national defense and security is the activity of bringing narcotic substances, precursors, and drug samples into or out of the territory of Vietnam or special areas on the territory of Vietnam considered as separate customs areas according to legal regulations by authorized units, individuals to serve the purposes of national defense and security.
The application dossier and procedures for granting permits for researching drugs, precursors are performed in accordance with the Law on Science and Technology and Circular 20/2022/TT-BCA dated April 29, 2022, by the Ministry of Public Security regulating the management of science and technology tasks in the People's Public Security.
The Department of Science, Strategy, and Public Security History presides, cooperates with the Drug Crime Investigation Public Security Department and related units of the Ministry of Public Security responsible for overseeing, inspecting, and monitoring research activities of drugs, precursors for the purposes of national defense and security.
Units granted permits to conduct research activities on drugs, precursors for the purposes of national defense and security are responsible for sending the research dossier of narcotic sources, precursors to the Drug Crime Investigation Public Security Department and subject to inspection, monitoring according to paragraph 2 of this Article and the provisions of Article 15 of Decree 105/2021/ND-CP dated December 4, 2021, by the Government of Vietnam.
