Recently, the Government of Vietnam promulgated Decree 95/2010/ND-CP regulating the licensing and coordination of activities with foreign search and rescue forces in Vietnam. Article 8 of Decree 95/2010/ND-CP stipulates the procedures for requesting or approving foreign search and rescue forces to participate in search and rescue operations in Vietnam as follows:
When an emergency situation arises, ministries and sectors according to their state management functions may need to request foreign search and rescue forces or if foreign search and rescue forces propose to participate in search and rescue operations, they must immediately propose to the National Search and Rescue Committee.
- The proposal must include:
- The country, international organization required or the country, international organization proposing to send search and rescue forces, means to Vietnam to participate in search and rescue operations;
- The estimated spatial and temporal scope for which the foreign search and rescue forces will conduct search and rescue operations;
- The forces, means, and areas where the foreign search and rescue forces can participate.
The National Search and Rescue Committee shall report to the Prime Minister of the Government of Vietnam on the proposals of the ministries and sectors and immediately notify the opinion of the Prime Minister of the Government of Vietnam to the Ministry of Foreign Affairs and relevant ministries and sectors for coordination in implementation.
