Vietnam: Word file of 10 schedules for registration for mortgage of land use rights from 2020

Specifically, components of registration for mortgage of land use rights and assets attached to land shall follow schedules attached to Circular No. 07/2019/TT-BTP of the Ministry of Justice of Vietnam, including:

1. Form 01/DKTC: Application for mortgage;

2. Form 02/DKTD-SCSS: Application for revision and error correction;

3. Form 03/DKVB: Application for issuance of notice on disposal of mortgage assets;

4. Form 04/XDK: Application for registration withdrawal;

5. Form 05/DKTC: Application for transition of registration for mortgage;

6. Form 06/BSCB: Addition of parties to mortgage agreements;

7. Form 07/BSTS: Addition of mortgage assets;

8. Form 08/DMHDTC: List of signed mortgaged agreements;

9. Form 09/SDKTL. Registry of mortgage of off-the-plan assets attached to land;

10. Form 10/VBTB: Notice of halt or suspension of mortgage registration; notice on distraint, release of distraint of land use rights or assets attached to land.

It should be noted that in case applicants register for mortgage of land use rights or assets attached to land before the effective date of Circular No. 07/2019/TT-BTP (January 10, 2020) and their applications are not handled, registering agencies shall adopt provision under this Circular to proceed with mortgage registration on the basis of application submitted by the applicants.

With respect to security interests in forms of land use rights and assets attached to land registered before the effective date hereof, applicants are not required to register again as per the law.
