Vietnam: Why do the police ask to change household registration due to temporary residence exceeding 12 months?

According to Article 23 of the Law on Residence of Vietnam: When a person who has a permanent residence moves from his or her lawful residence to a new lawful residence and meets the conditions for permanent residence registration, that person is responsible for following the procedure for changing the permanent residence within 12 months.

According to the above regulation, in case of moving household registration from one district to another, you must be responsible for completing procedures to change your place of permanent residence. If you have temporarily resided for more than 12 months without registering for permanent residence, you may be subject to an administrative penalty of VND 100,000 to VND 300,000 for “not comply with the regulations on registration of permanent or temporary residence or adjust the changes in the family register or temporary residence book” as specified in Article 8 of Decree No. 167/2013/NĐ-CP of Vietnam’s Government.

Documents and procedures for transferring household registration from one district to another include:

- Apply for household transfer certificate: Submit a set of documents including household registration book and notice of change in household registration and demographics to the ward police; After two days from the date of receipt of the application, the police agency will issue a certificate of transfer of household registration to you.

- Register permanent residence in the new district: Submit application for permanent residence registration at the district police agency.

According to Article 21 of the Law on amendments to the Law on Residence in 2013 of Vietnam, a permanent residence registration dossier comprises a written notification of changes in household registration, number of household members; a declaration on household members; a paper on household registration transfer; papers and documents evidencing the lawful domicile.

Within fifteen days after the receipt of complete dossiers, the competent agencies shall grant household registration books to permanent residence registration dossier submitters; in case of refusal to grant, they shall give written replies clearly stating the reasons therefor.
