Vietnam: Which agency shall have the power to decide on establishment of a management board of a project funded by ODA?

On September 22, 2016, the Ministry of Planning and Investment of Vietnam issued Circular No. 12/2016/TT-BKHDT, which specifies the power to decide on establishment of a management board of a project funded by ODA.

According to Circular No. 12/2016/TT-BKHDT, the power to decide on establishment of a management board of a project funded by ODA is specified as follows:

- Where the project owner does not have a legal status, the governing body shall issue a decision on establishment of the project management board.

- Where a project management board is not established, the governing body shall issue a decision to assign project management to the project owner.

Besides, Circular No. 12/2016/TT-BKHDT also stipulates that within 05 working days from the issuance date of the decision to establish the project management board or decision on additional tasks of the existing project management board, the project owner shall send copies of such decision to the Ministry of Planning and Investment, the Ministry of Finance, relevant authorities, and the foreign sponsor.
