Vietnam: When do officials and public employees have their regular salary increase deadlines extended?

This is a question that has been received quite frequently recently by LawNet from Clients and Members. LawNet would like to address this issue in the article below.

According to Clause 1, Article 2 of Circular 08/2013/TT-BNV of the Ministry of Home Affairs of Vietnam, the duration of holding a salary rank to consider regular salary rank promotion for officials and public employees is stipulated as follows:

- For senior expert positions: If not yet positioned at the final salary rank in the senior expert salary table, after 5 years (full 60 months) holding the salary rank in the senior expert salary table, they will be considered for a one-rank salary promotion;

- For titles requiring education levels from college upwards: If not yet positioned at the final salary rank in the title or rank, after 3 years (full 36 months) holding the salary rank in the title or rank, they will be considered for a one-rank salary promotion;

- For titles requiring education levels from intermediate or lower and execution, service employees: If not yet positioned at the final salary rank in the title or rank, after 2 years (full 24 months) holding the salary rank in the title or rank, they will be considered for a one-rank salary promotion.

However, during the period of holding the current salary rank, if officials and public employees and workers have received a notification or written decision from the competent authority about not completing the assigned annual tasks or being disciplined in forms such as reprimand, warning, demotion, or dismissal, the regular salary rank promotion period will be extended beyond the regulated time as follows:

Cases of extended period for regular salary rank promotion

Extended duration

Officials disciplined by dismissal

12 months

Officials disciplined by demotion or dismissal

Public employees and workers disciplined by dismissal

Officials disciplined by reprimand or warning

06 months

Public employees and workers disciplined by warning

Officials and public employees and workers not completing annually assigned tasks

Officials and public employees and workers with 2 non-consecutive years of not completing assigned tasks during the holding period

Each year of not completing assigned tasks extends by 06 months

Public employees and workers disciplined by reprimand

03 months

In cases where officials and public employees and workers both do not complete assigned tasks and are disciplined, the regular salary rank promotion period will be extended

The total extended period as per the above regulations
