Vietnam: What regulations must drivers and occupants of motorcycles and mopeds comply with?

On June 01, 2020, the Ministry of Public Security submitted the Draft Law on ensuring road traffic order and safety to the National Assembly of Vietnam for consideration.

According to the Draft Law on ensuring road traffic order and safety of Vietnam, when participating in road traffic, drivers and occupants of motorcycles, mopeds (including electric scooters), moped-like vehicles and motorcycle-like vehicles must comply with the following regulations:

1. Operators of two-wheeled motorcycles, mopeds, moped-like vehicles and motorcycle-like vehicles may carry only one person, except for the following cases, where they may carry a maximum of two people:

- Transporting the patient to the emergency room;

- Escorting people who commit illegal acts;

- Children under 14 years old.

2. Drivers and occupants of two-wheeled motorbikes, three-wheeled motorcycles and mopeds must wear helmets for motorcyclists and mopeds with properly fitted straps.

3. Operators of two-wheeled motorcycles, three-wheeled motorcycles, mopeds, moped-like vehicles and motorcycle-like vehicles are not allowed to commit the following acts:

- Riding in a horizontal row of 3 or more vehicles;

- Riding on the roadway for pedestrians and other vehicles;

- Using a cell phone; using audio equipment, except for hearing aid devices, using an umbrella;

- Use the vehicle to pull, push other vehicles, other objects, guide animals, carry bulky objects; carrying people standing on the saddle, cargo rack or sitting on the handlebars; loading goods on the vehicle beyond the prescribed limit;

- Release both hands while operating the vehicle; steering with the legs; sitting on one side to operate the vehicle; lying on the seat while operating the vehicle; swapping positions while operating the vehicle; turning the whole body to the back or wearing a blind fold while operating the vehicle;

- Other acts causing disorder and traffic safety.

4. Persons riding on two-wheeled motorbikes, three-wheeled motorbikes, mopeds, moped-like vehicles and motorcycle-like vehicles when participating in traffic are not allowed to commit the following acts: Carrying bulky objects; Using an umbrella; Grabbing, pulling or pushing other vehicles; Standing on the saddle, rack or sitting on the handlebars; Other acts causing disorder and traffic safety.
