Vietnam: What does the applications to send drug addicts to rehabilitation centers for compulsory rehabilitation include?

Recently, the Government of Vietnam issued Decree 221/2013/ND-CP regulating policies on the application of administrative handling measures for rehabilitation centers in Vietnam.

Vietnam: What does the applications to send drug addicts to rehabilitation centers for compulsory rehabilitation include? (Illustration image)

Article 9 of Decree 221/2013/ND-CP stipulates that the applications to send drug addicts to rehabilitation centers for compulsory rehabilitation includes:

1. For drug addicts with a stable place of residence in Vietnam:

- Summary of personal details;

- Result response form from the authority defined in Clause 1, Article 10 of Decree 221/2013/ND-CP about the current drug addiction status of the individual proposed to be subjected to compulsory rehabilitation;

- Record of illegal drug use behavior;

- Report from the violator or their legal representative;

- Documents proving the completion of the Decision to apply educational measures at the commune, ward, commune-level town, including: Decision to apply educational measures at the commune, ward, commune-level town due to drug addiction, and Certificate of completion of the Decision to apply educational measures at the commune, ward, commune-level town due to drug addiction from the Chairman of the commune-level People's Committee;

- Confirmation of the completion of home-based or community-based drug addiction treatment from the Chairman of the commune-level People's Committee, or documents proving removal from the opiate replacement therapy program;

- Decision from the Chairman of the commune-level People's Committee to assign the family to manage the individual proposed to be subjected to compulsory rehabilitation during the procedure for bringing them into the compulsory rehabilitation center;

- Document from the authority preparing the dossier proposing the application of measures to bring the individual into the compulsory rehabilitation center.

2. For drug addicts without a stable place of residence in Vietnam:

- Summary of personal details;

- Result response form from the authority defined in Clause 1, Article 10 of Decree 221/2013/ND-CP about the current drug addiction status of the individual proposed to be subjected to compulsory rehabilitation;

- Record of illegal drug use behavior;

- Report from the violator or their legal representative;

- Document from the authority preparing the dossier proposing the application of measures to bring the individual into the compulsory rehabilitation center;

- Decision from the Chairman of the commune-level People's Committee to assign a social organization to manage the individual proposed to be subjected to compulsory rehabilitation during the procedure for applying the compulsory rehabilitation measure.
