Vietnam: What documents must the contents of cosmetics advertisements be conformable with?

According to Article 4 of Decree No. 181/2013/NĐ-CP of Vietnam’s Government, the contents of cosmetics advertisements must be conformable with:

- The announcement of cosmetics prescribed in pharmacy laws;

- Documents proving the safety and effects of the cosmetics, instructions on announcement of cosmetics effects given by an international association (if any).

Moreover, a cosmetics advertisement must contain:

- Names of the cosmetics;

- Effects and uses of the cosmetics;

- Name and address of the entity in charge of launching the product;

- The warnings prescribed in international agreements.

Notably, do not advertise cosmetics in a way that causes people to confuse them with medicines. The information mentioned names, effects and uses of the cosmetics, the warnings prescribed in international agreements must be clearly spoken when advertising cosmetics on audio and video news.

Besides, Decree No. 181/2013/NĐ-CP also stipulates advertisements for medical services, specifically, the contents of advertisements for medical services must be conformable with the license to provide medical services of the medical facility or the practicing certificate of the medical practitioner. 

An advertisement for medical services must contain:

- Name of the licensed medical facility;

- The scope of operation written in the operating license or practicing certificate issued by a competent authority.
