On April 17, 2014, the Ministry of Justice of Vietnam issued Circular 11/2014/TT-BTP on the assurance of gender equality in legal aid.
Vietnam: What are the regulations on the organizational structure and the force of legal aid-providing persons? (Illustrative image)
In Article 6 of Circular 11/2014/TT-BTP, specific regulations on the organizational structure and the force of legal aid-providing persons in the assurance of gender equality in legal aid in Vietnam are as follows:
- The legal aid-providing organization assigns a unit or official as the focal point for advising to assure gender equality in legal aid.
- The legal aid-providing organization regularly reviews and assesses the current situation and proposes solutions to the competent authority to improve the organizational structure, building the force of legal aid-providing persons, ensuring gender structure between men and women in leading and managerial positions (Director, Deputy Director, Head, Deputy Head of Departments, Specialized Committees, Branches), in the team implementing legal aid (Legal Aid Officers, Legal Aid Collaborators, Lawyers, Legal Advisors) and other employees.
- The development and building of the force of collaborators must ensure the gender structure between men and women according to locations, fields, and forms of providing legal aid in accordance with legal regulations and local practical conditions. Facilitating women who are ethnic minorities or have knowledge and skills about gender, gender equality, domestic violence prevention, human trafficking prevention, and sexual abuse to act as collaborators is encouraged.
