Vietnam: What are the cases of removal of state property within the Ministry of National Defense from the property distribution?

This is an important content regulated in Circular 126/2020/TT-BQP on removal from the property distribution and disposal of state property within the Ministry of National Defense of Vietnam, dated October 19, 2020.

Vietnam: What are the cases of removal of state property within the Ministry of National Defense from the property distribution? (Illustrative image)

According to Circular 126/2020/TT-BQP, property are removed from property distribution in Vietnam if:

  1. They have been used beyond the regulated period and cannot continue to be used.

  2. They are severely damaged, cannot be repaired, restored, and extended for further use, or repairs are not effective.

  3. They are lost or damaged; not included in the equipment planning or lack synchronization, with a small quantity remaining for many years, outdated, and no longer needed for military and defense tasks.

  4. They are no longer needed or with reduced necessity due to changes in functions, tasks, or organizational structure.

  5. They are transferred out to agencies and units outside the military by the decision of the competent authority.

  6. They are combat structures, defense works, houses, and property attached to the land that must be dismantled by the decision of the competent authority to clear the land for investment projects or according to planning and other cases as regulated by the State and the Ministry of National Defense of Vietnam.

Simultaneously, the removal of property from property distribution in Vietnam must ensure the following principles:

- Only proceed with the removal and disposal of property upon decision by the competent authority.

- Utilize the technical equipment, materials, and goods that still have usage potential for military and defense tasks.

- For items, materials, and scrap recovered after ammunition disposal; technical equipment, materials, and goods that can no longer be utilized for military and defense tasks must have their military functions deactivated and their capability to be restored (for equipment storing information) before disposal.
