The Government of Vietnam issued Decree No. 07/2015/NĐ-CP regulating the functions, tasks, powers and organizational structure of the Competition Council.
According to Article 1 of Decree No. 07/2015/NĐ-CP of Vietnam’s Government, the Competition Council is an independent competition litigation agency established by the Government, with the function of organizing and resolving complaints about competition cases related to anti-competitive practices. The Competition Council's trading name in English is Vietnam Competition Council, abbreviated as VCC.
The Government regulates in detail the duties and powers of the Competition Council, specifically as follows:
First, on the organization of handling and resolving competition cases related to anti-competitive practices:
- Organize the receipt of Investigation Reports and Competition Case Files related to anti-competitive practices as prescribed in Article 93 of the Law on Competition of Vietnam;
- Penalize and handle violations of competition law according to the provisions of Article 119 of the Law on Competition of Vietnam;
- Request relevant organizations and individuals to provide information and documents necessary to carry out assigned tasks.
Secondly, about complaint resolution:
- Resolve complaints about decisions on handling competition cases related to anti-competitive behavior of the Council for Handling Competition Cases in accordance with the provisions of competition law;
- Resolve complaints against other decisions of the Competition Council, Chairman of the Competition Council, Competition Case Handling Council, and Chairman of the Hearing according to the order and procedures of the law on complaints.
Thirdly, regarding participation in administrative proceedings: Participate in administrative proceedings according to the provisions of competition law and administrative procedure law.
- Monitor the implementation of Decisions on handling competition cases;
- Participate in comments on legal documents, strategies, industry and field planning, and relevant administrative documents;
- Propagate and disseminate competition law within the scope of authority;
- Organize scientific research, build databases and documents related to the functions, tasks and powers of the Competition Council;
- Internationally cooperate in competition within jurisdiction;
- Annual or extraordinary report at the request of the Government and Prime Minister on the activities of the Competition Council;
- Other tasks within scope of authority.
