Vietnam: What are responsibilities of People's Committees at all levels in regulations on employment of people under the age of 15?

On June 25, 2020, the Ministry of Labor - War Invalids and Social Affairs of Vietnam issued the Draft Circular on the employment of people under the age of 15 to work.

The Draft Circular has stipulated responsibilities of People's Committees at all levels in regulations on employment of people under the age of 15 as follows:

1. People's Committees of provinces and central-affiliated cities direct the Department of Labour, Invalids and Social Affairs to:

- Coordinate with the state management agency in charge of Culture, Sports and Tourism, and the local Labor Confederation to regularly urge, inspect and supervise the implementation of this Circular;

- Guide, examine and inspect the use of persons under the age of 15 to work in the province or city;

- Verify and notify in writing of consent or disapproval for the employer to employ a person under the age of 13 as prescribed in Clause 2, Article 14 of this Circular;

- Organize training, retraining and improvement of professional capacity in management, examination and inspection of the employment of persons under the age of 15;

- Apply information technology in managing the employment of under-15s working in the locality;

- Summarize and report to the Ministry of Labor, War Invalids and Social Affairs every 6 months (before June 25), annually (before December 25) and irregularly on the situation of employing people under the age of 15 to work in the province or city.

2. People's Committees of districts direct the Department of Labour, Invalids and Social Affairs to:

- Coordinate with the State management agency in charge of Culture - Sports and Tourism, the district-level Labor Confederation in guiding, monitoring, evaluating, inspecting the employment of people under the age of 15 working in the district;

- Summarize and report to the Department of Labor, War Invalids and Social Affairs every 6 months (before June 20), annually (before December 20) and irregularly on the situation of using people under 15 years old to work in the locality.

3. People's Committees of communes:

- Guide and inspect the use of persons under the age of 15 working in communes; support the employer to strictly comply with the provisions of this Circular; appoint people to participate in professional training courses organized by the Department of Labor, War Invalids and Social Affairs;

- Handle cases of employing people under the age of 15 to work in violation of this Circular; provide timely intervention and support services;

- Summarize and report to the Department of Labor, War Invalids and Social Affairs every 6 months (before June 15), annually (before December 15) and irregularly on the situation of using people under 15 years old to work in the locality.
