Vietnam: What are compositions of an application for approval for a ship’s name?

On September 15, 2020, the Decree No. 86/2020/NĐ-CP of Vietnam’s Government providing amendments to Decree No. 171/2016/NĐ-CP dated December 27, 2016 on registration, deregistration, sale and purchase, and building of ships will come into force.

Specifically, according to Clause 5 Article 1 of Decree No. 86/2020/NĐ-CP of Vietnam’s Government amending Points b, c, d Clause 2 and Point a Clause 4 Article 8 of Decree No. 171/2016/NĐ-CP dated December 27, 2016, an application for approval for a ship’s name includes:

1. The application for approval for a given ship name made according to the Form No. 05 stated in the Appendix enclosed with Decree No. 171/2016/NĐ-CP;

2. The ship sale and purchase agreement or the shipbuilding contract or other documentary evidences, of equivalent legal validity, proving the ownership of ship (certified true copy or copy presented with its original for verification purpose, notarized translation if such document is made in a foreign language); 

3. The business registration certificate or enterprise registration certificate or Certificate of registration for a cooperative or co-operative union (certified true copy or copy presented with its original for verification purpose).   Where the shipowner is a foreign organization, the license to establish a branch or representative office in Vietnam (certified true copy or copy presented with its original for verification purpose) is required;

4. Where the shipowner is an individual, his/her ID card or Citizen Identity Card or passport (certified true copy or copy presented with its original for verification purpose) is required; where the shipowner is a foreigner, his/her passport (certified true copy or copy presented with its original for verification purpose) is required.

Notably, the ship registration office shall receive application and carry out the following procedures:

1. With regard to an application submitted directly, the ship registration office shall instruct the applicant to complete it, if it is invalid, or record it into the monitoring book and grant an application confirmation slip giving an appointment to the applicant within the prescribed time limit;

2. With respect of applications received by post, the registrar of ship shall, within 02 working days as of the receipt of the invalid application, provide instructions to the applicant to complete that application in conformity with regulations herein;

3. Within 02 working days as of the receipt of valid application, the registrar of ship shall give a written approval for the ship name given by the shipowner. If the application is refused, a written response indicating reasons thereof shall be given to the shipowner.
