Vietnam: Unusual transaction reports must be sent within 24 hours since the unusual transactions detected

On November 16, 2020, the Ministry of Finance of Vietnam issued the Circular No. 95/2020/TT-BTC on guidance on supervision of securities transactions on the securities market.

According to Article 14 of the Circular No. 95/2020/TT-BTC of the Ministry of Finance of Vietnam, unusual transaction reports are specified as follows:

- Stock Exchanges shall send the State Securities Commission (SSC) and Vietnam Exchange (VNX) reports on unusual transactions that are detected within 24 hours after the unusual transaction analysis results are available.

- The unusual transaction reports mentioned in Clause 1 of this Article shall be case-specific. Each report shall specify the unusual signs, relevant information, opinions and proposed actions to be taken by the Stock Exchanges (or another authority if the case is beyond its jurisdiction).

- Unusual transaction reports shall be sent and received in accordance with Clause 4 Article 13 of this Circular.

Ad hoc supervision reports:

- VNX and its subsidiary companies shall send supervision reports when requested in writing by SSC.

- The reports mentioned in Clause 1 of this Article shall be made in both physical and electronic forms, have the contents and are sent by the deadline specified by SSC.
