Recently, the Ministry of Public Security has submitted the Draft Law on ensuring road traffic order and safety to the National Assembly of Vietnam for consideration. This Draft Law has stipulated penalties for violations of road traffic order and safety.
According to the Draft Law on ensuring road traffic order and safety of Vietnam, fines and suspension of driving license or certificates of training in knowledge about the road traffic law shall be imposed to motor vehicle operators who commit one of the following acts:
- Drugs in the body, alcohol in the blood or breath;
- Failure to comply with the request for testing on drugs and alcohol concentration of law enforcement officers;
- Motorcycles, mopeds, tractors and special-use motorcycles with a design speed of less than 70 km/h entering the freeway (except for vehicles serving, managing and maintaining freeways);
- Going against the traffic direction on a freeway, backing up on a freeway, except for emergency vehicles on duty;
- Weaving, speeding, illegal racing;
- Operating cars exceeding the speed limits by more than 35 km/h, operating motorcycles, mopeds, special-use motorcycles exceeding the speed limits by more than 20 km/h;
- Passenger cars (except buses) carrying more than 50% to 100% of the number of people allowed to carry;
- Cars carrying goods exceeding the allowable tonnage by more than 150%;
- Cars carrying goods with the total weight of the vehicle or the axle load exceeding the allowable load of the bridge or highway by more than 150%;
- Disobeying the order for weight or size inspection;
- Violation of road traffic order and safety causes traffic accidents; failure to stop, protect the scene, inform the authority, or give first aid to the victim after causing an accident;
