Vietnam: The time limit for investigation of occupational diseases is within 45 days

In 2016, the Ministry of Health of Vietnam issued Circular No. 28/2016/TT-BYT on management of occupational diseases.

According to Circular No. 28/2016/TT-BYT of the Ministry of Health of Vietnam, the time limit for investigation is within 45 days from the effective date of the decision to establish an investigation team. Investigation procedures are as follows:

- Examine the workplace;

- Collect evidence and documents about the occupational diseases;

- Examine documents about occupational hygiene, workers’ health and occupational diseases at the workplace;

- Interview workers, the employers and other persons at the workplace related to the management of occupational hygiene, workers’ health and occupational diseases;

- Carry out examinations and necessary tests if workers are suspected of having occupational diseases;

- Other contents decided by the chief of the investigation team.

Provisions on disclosing the investigation record can be found in Circular No. 28/2016/TT-BYT of the Ministry of Health of Vietnam, which takes effect from August 15, 2016.
