Vietnam: The probationary period is 12 months for C-class officials

Recently, the Government of Vietnam has issued the Decree No. 138/2020/NĐ-CP of the Government of Vietnam on recruitment, employment and management of officials.

According to Article 20 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, people recruited into officials must carry out the probationary regime to familiarize themselves with the working environment and practice doing the jobs of the recruited positions. The probationary period is specified as follows:

- 12 months in case of recruitment of C-class officials;

- 06 months in case of recruitment of D-class officials;

- The period of maternity leave under the social insurance regime, the period of sick leave of 14 days or more, period of unpaid leave, period of detention, custody or temporary suspension from work as prescribed by law shall not be counted into the probationary period.

Note: In case the probationer takes sick leave or has a valid reason for less than 14 days but is agreed by the head of the agency or unit where he/she is recruited as an official, this period is counted during the probation.

Moreover, Article 20 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government also stipulates training content, including:

- Firmly grasp the provisions of the law on officials; firmly grasp the organizational structure, functions, tasks and powers of the working agency; the agency's working rules and regulations and the responsibilities and tasks of the job position to be recruited;

- Cultivate knowledge and professional skills as required by the job position to be recruited;

- Practice solving and performing the work of the job position to be recruited.

During the period of implementation of the probationary regime, the head of the agency managing and employing officials must appoint the person conducting the probationary regime to participate in a training course on state management to perfect the standards and conditions of the officials rank before appointment.
