Recently, the Government of Vietnam has issued the Decree No. 138/2020/NĐ-CP on recruitment, use and management of officials.
According to Article 53 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, at least 90 days before the expiration of the appointment time limit, the authority competent to extend the time holding a leadership or managerial position must issue a notice to consider extending the time holding a leadership or managerial position for officials. Officials make reports to self-assess and evaluate the performance of their responsibilities and tasks during their time in office, and send them to competent authorities to extend their time holding leadership and management positions.
After that, the heads and collective leaders of agencies and organizations discuss and consider, if the official is still healthy, reputable, meeting the requirements of the task, then unanimously vote by secret ballot. Personnel proposed to extend the time holding leadership and management positions must reach the agreement of more than 50% of the total number of members of the leadership team; in the case of personnel reaching the rate of 50%, it shall be decided by the head; at the same time fully report different opinions for competent authorities to consider and decide.
Finally, the head of an agency or organization shall issue a decision according to its competence or submit it to a competent authority for consideration and decision on the extension of the time holding a leadership or managerial position to the retirement age for officials.
