Vietnam: The mediator’s card must not be used for purposes other than the mediation tasks

This is an important content of the Circular No. 04/2020/TT-TANDTC guiding the process of appointment, re-appointment, dismissal, commendation and handling of violations; issuance and withdrawal of mediator’s card, issued by the Chief Justice of the Supreme People's Court of Vietnam.

The mediator’s card must not be used for purposes other than the mediation tasks specified in Article 12 of Circular No. 04/2020/TT-TANDTC of the Chief Justice of the Supreme People's Court of Vietnam, specifically:

- The mediator’s card is issued to the person appointed as a mediator at the People's Courts, to be used in the course of performing the task of mediation and dialogue at the Court; must not be used for anything other than the mediator's duties.

- The form of the mediator’s card shall be prescribed by the Chief Justice of the Supreme People's Court, specifically as follows:

+ Dimensions: Length 95 mm, width 62 mm.

+ Front side: Blue background, on top is the words "CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM" in bold, red, capitalized VnArialH font, font size 10; in the middle is the Court’s logo with a diameter of 20 mm; below the Court’s logo is the words "THẺ HÒA GIẢI VIÊN" in VnArialH font, red, capitalized, font size 13.

+ Back side: White background with sunken pattern, yellow color; in the middle is an imprinted bronze drum; upper left corner is the Court’s logo with a diameter of 9.8 mm; the lower left corner has the mediator's photo (20x30 mm); have information about full name, date, month, year of birth, term, place of employment, date of issuance of mediator’s card.

+ The photo is watermarked by the issuing authority.

Procedures for granting a mediator’s card are carried out as follows:

- The person who is appointed or re-appointed to be the mediator shall make a declaration to request the issuance of a mediator’s card (made according to Form No. 09, enclosed with 02 photos of 20x30 mm) and send it to the Court where he/she works.

- The Court where the mediator works shall receive the declaration, check and compare information, confirm the declaration, and send it to the People's Court of the province (via advisory unit on organization and personnel of the provincial People's Court).

- Within 03 working days from the date of receipt of the declaration requesting the issuance of the card, the unit advising on the organization and staff of the provincial People's Court shall issue the mediator’s card according to the provisions of Circular No. 04/2020/TT-TANDTC.

Grant authority: The Chief Justice of the People's Court of the province shall grant the mediator’s card to the person who is appointed and re-appointed to be the mediator of the People's Court of the province and the People's Court of the district under his/her management.
