Recently, the State Bank of Vietnam has issued the Circular No. 14/2020/TT-NHNN on judicial survey in respect of currency and banking sector.
According to Article 20 of the Circular No. 14/2020/TT-NHNN of the State Bank of Vietnam, time limit for judicial expertise is stipulated as follows:
- Within 09 days for the case specified in Clause 3, Article 14 of this Circular;
- Within 01 month for the case of assessment of banknotes and coins issued by the State Bank;
- Within 01 month for the case of assessment of foreign exchange activities and gold trading activities;
- Within 03 months for the case of assessment of banking operations, including activities: granting credit, receiving deposits and providing payment services through accounts;
- Within 01 month for deposit insurance assessment;
- Within 04 months for the case of expertise in a case with 02 or more different expertise contents in the monetary and banking domains specified in Article 3 of this Circular or more complex in nature, involving many organizations and individuals.
Note: The time limit for judicial expertise prescribed in Clause 1 of this Article is counted from the date the State Bank receives the decision of the expert solicitor and fully receives the application, expertise object, information and documents, objects and specimens mentioned in the decision soliciting expertise; additional dossiers, objects of assessment, information, documents, objects and specimens (if any); or from the date on which the judicial expert, the solicited case-based judicial expert directly receives the decision of the expert solicitor and receives all the dossiers, expertise objects, information and documents, objects and specimens mentioned in the decision to solicit expertise; additional dossiers, objects of assessment, information, documents, objects and specimens (if any).
