Vietnam: The Legal Department of the Ministry of Defense provides advice to assist the Minister of Defense in controlling administrative procedures

This is one of the responsibilities of the Legal Department of the Ministry of Defense specified in Circular No. 92/2015/TT-BQP regulating and guiding the activities of administrative procedure control within the scope of the state management functions, issued on August 11, 2015 by the Ministry of Defense of Vietnam.

Specifically, according to Article 32 of Circular No. 92/2015/TT-BQP of the Ministry of Defense of Vietnam, the Legal Department of the Ministry of Defense shall have the following responsibilities:

1. Provide advice to assist the Minister of Defense in implementing the control of administrative procedures within the Ministry of Defense.

2. Participate in giving opinions and appraising legislative documents that regulate administrative procedures; receive and handle feedback and recommendations related to administrative procedures.

3. Take charge and coordinate with relevant agencies and units in developing plans for implementing the control of administrative procedures; plans for reviewing and evaluating provisions on administrative procedures on an annual basis, submit them to the Minister of Defense for consideration, decision, and submission to the Administrative Procedures Control Agency of the Ministry of Justice before January 31st of the planned year.

4. Compile and develop regular reports every 6 months and annual reports on the situation and results of implementing administrative procedures control activities within the Ministry of Defense, submit them to the Ministry of Justice or submit irregular reports upon the request of the Government or the Prime Minister.

5. Organize training and professional development for legal officers, officers involved in administrative procedures control, and officers assigned with the task of implementing administrative procedures control.

6. Establish documentation and administrative procedure records in the National Database on Administrative Procedures.

7. Request the Administrative Procedures Control Agency of the Ministry of Justice to publish data on administrative procedures in the National Database on Administrative Procedures.
