Vietnam: The investor must send the contract to the appraisal agency within 05 days

This is an important content of the Circular No. 39/2015/TT-BNNPTNT of the Ministry of Agriculture and Rural Development of Vietnam stipulating a number of contents on the selection of contractors for construction investment projects using public investment capital managed by the Ministry of Agriculture and Rural Development of Vietnam, promulgated on October 20, 2015.

Specifically, according to Article 13 of the Circular No. 39/2015/TT-BNNPTNT of the Ministry of Agriculture and Rural Development of Vietnam, immediately after the bid opening, the investor must keep 01 set of copies of EOI responses, Prequalification Application, Bidding Documents, Proposals with sealed signatures clearly stating the full name, unit of the representatives of the bidders attending the bid opening ceremony, the investor responsible before the law for confidentiality (during the validity period of the dossier) in accordance with current regulations. Contents and specifications for sealing 01 set of copies of the above documents must be included in the Request for Proposals, EOI requests, Prequalification Documents and Bid Documents for the investor and the contractor to implement.

Particularly for domestic projects, within 03 working days after approval (by postmark), the investor must send to the appraisal agency under the Ministry the following documents:

- The approval decision shall be enclosed with 01 set of Request for Proposals, EOI requests, Prequalification Documents and Bid Documents (including the approved design dossier and estimate of the bidding package).

- Decision approving the list of contractors meeting technical requirements (including evaluation report of expert group, appraisal report of investor).

- Decision approving the results of prequalification, contractor selection results, contractor appointment results (including evaluation report of expert group, appraisal report of investor).

In addition, for bidding packages under official development assistance (ODA) projects, the investor must send 01 set of approved Request for Proposals, EOI requests, Prequalification Documents and Bid Documents; the list of contractors meeting the technical requirements and the results of contractor selection on the project owner for checking and consideration before consulting the Sponsor. When sending dossiers for Sponsor’s opinion, the project owner must send it to the appraisal agency under the Ministry for synthesis, monitoring and supervision. Heads of CPO Committees, directors of Project Management Units must be responsible to the Minister for Request for Proposals, EOI requests, Prequalification Documents and Bid Documents, steps of assessment of Proposals, EOI responses, Applications and Bids and contractor selection results in accordance with the order, procedures and provisions of law and of the Sponsor.

Note: Within 05 working for the date of signing contract, the investor must send the signed Contract (including the contract appendix and the amended and supplemented contract appendix) to the appraisal agency under the Ministry for monitoring and supervision.
