Vietnam: The foundation license of establishments to support victims of human trafficking is valid for 05 years

This is a notable content of Decree No. 09/2013/ND-CP dated January 11, 2013 of Vietnam’s Government detailing a number of articles of the Law on Human Trafficking Prevention and Combat.

According to Decree No. 09/2013/ND-CP of Vietnam’s Government, a foundation license of establishments to support victims of human trafficking is valid for 5 (five) years. The Chairman of provincial-level People’s Committee shall base on the written proposal of the provincial-level Service of Labor, Invalids and Social Affairs to grant a foundation license. Specifically, a foundation license comprises the following principal contents:

- Name, address of the head office, telephone number, and fax number (if any) of the victim support establishment;

- Full name of the head of the victim support establishment;

- Operation scope and support services.

Time limit for granting a foundation license:

- Within 7 (seven) working days after receiving a written proposal from the provincial- level Service of Labor, Invalids and Social Affairs, the Chairman of provincial-level People’s Committee  shall grant a foundation license;

- In case of disapproval for granting a foundation license, within 3 (three) working days, the Chairman of provincial- level People’s Committee shall issue a written reply specifying the reason.

Besides, according to Article 10 of Decree No. 09/2013/ND-CP, cases ineligible for granting foundation license include:

- Foreign organizations and individuals.

- Vietnamese organizations and individuals subject to one of the following cases:

+ Failing to meet all the conditions specified in Article 4 of this Decree;

+ The foundation of the victim support establishment is harmful to national defense and security, social order and safety or is taken advantage of foundation of establishment to commit law-breaking acts;

+ The dossier is invalid.
