Vietnam: The forcible civil enforcement cost is 150,000 VND/person/day

Vietnam: The forcible civil enforcement cost for the presiding officer is 150,000 VND/person/day; for members, it is 100,000 VND/person/day.

For enforcement officers, other officials performing judgment execution duties, prosecutors, police officers, militia, self-defense forces, and local government representatives directly participating in the enforcement, the presiding officer is 150,000 VND/person/day for participating in the enforcement, and for other participants, it is 100,000 VND/person/day.

Representatives of neighborhood groups, village chiefs, village elders, hamlet heads, and other individuals mobilized to participate in the enforcement of civil judgments in necessary cases receive 100,000 VND/person/day for participation in the enforcement.

In the case of enforcement officers, other officials performing judgment execution duties, prosecutors, police officers, the expense level is 70,000 VND/person/day; for militia, self-defense forces, local government representatives, and other participants, it is 100,000 VND/person/day.

Advance payment of enforcement costs for civil judgments when the cost of enforcement has not yet been collected from the debtor, creditor, or a third party bearing the enforcement cost; the civil judgment enforcement agency shall advance the necessary funds for enforcement officers to organize the enforcement from the budget allocated by the competent authority to the civil judgment enforcement agency.

Reimbursement of advanced enforcement costs after handling assets or collecting money from the party responsible for the enforcement cost; the enforcement officer must immediately complete the procedure to reimburse the previously advanced enforcement costs to the civil judgment enforcement agency.

In the case where the involved party voluntarily pays the enforcement costs in advance following the provisions of point b clause 1 Article 45 of Decree 62/2015/ND-CP, the civil judgment enforcement agency, based on the enforcement plan and estimated cost for enforcement, shall determine the amount of funds to be paid by the involved party.

Circular 200/2016/TT-BTC takes effect in Vietnam from January 1, 2017, and is implemented from the 2017 fiscal year.
