Vietnam: The enterprise is not required to append a seal on certain documents of the application of enterprise registration

On August 23, 2018, the Government of Vietnam issued Decree No. 108/2018/NĐ-CP on amendments to some Articles of Decree No. 78/2015/NĐ-CP on enterprise registration.

Decree No. 108/2018/NĐ-CP of Vietnam’s Government supplements the regulation that the enterprise is not required to append a seal on:

- The application form for enterprise registration;

- Notification of changes of enterprise registration;

- Resolutions, decisions and minutes of meeting in the application for enterprise registration.

With regard to authorization of enterprise registration, Decree No. 108/2018/NĐ-CP stipulates that:

- The letter of attorney as prescribed by law is not required to be notarized or certified.

- The subject of authorization is "the person establishing the enterprise or the enterprise" is amended to the phrase "the person that has the power to sign the application form for enterprise registration".
