Vietnam: Tasks and powers of sub-ministerial inspectorates of natural resources and environment

Recently, the Government of Vietnam promulgated Decree 35/2009/ND-CP on the organization and operation of the Inspectorate of Natural Resources and Environment.

Article 12 of Decree 35/2009/ND-CP specifies the tasks and powers of sub-ministerial inspectorates of natural resources and environment in Vietnam as follows:

- Perform duties and exercise powers in specialized inspection of natural resources and environment within the state management scope of the General Department and Department.

- Impose administrative penalties under law regulations on handling administrative violations.

- Preside over or participate in the development of legislative documents as assigned by the Director General or Director; propose to competent authorities amendments and supplements to legislative documents in line with the requirements of state management over natural resources and environment.

- Propose to competent authorities to suspend illegal acts of organizations or individuals when there is sufficient basis to determine that the violations cause damage to state interests, rights and legitimate interests of citizens; propose to competent state agencies to suspend the enforcement or annul decisions contrary to regulations on natural resources and environment; propose the handling of officials with detected violations in the performance of public duties through inspection work.

- Monitor, inspect, and urge the implementation of conclusions, recommendations, and handling decisions regarding inspection work of the Inspectorate of the General Department and the Department.

- Receive citizens and settle disputes, complaints, and denunciations within the management function of the General Department and Department as assigned by the Minister.

- Perform tasks related to anti-corruption as prescribed by law.

- Summarize and report on inspection activities, settlement of complaints and denunciations, and anti-corruption under the management scope of the General Department and Department.

- Perform other tasks the Minister, Director General, or Director assigns.
