Recently, the Government of Vietnam issued Decree 37/2009/ND-CP stipulating the important objectives in politics, economics, diplomacy, science and technology, culture, and society that the People's Public Security Force is responsible for armed guarding and protecting and the responsibilities of relevant agencies and organizations.
Vietnam: Targets regarding politics, economics, diplomacy, science – technique, and society
The general regulations on important targets regarding politics, economics, diplomacy, science – technique, and society in Vietnam under Decree 37/2009/ND-CP are as follows:
+ Principle of protecting the targets:
- Protection of the targets must adhere to the provisions of the law; ensure absolute safety of the targets; protect the interests of the state and the legal rights and interests of organizations and individuals.
- Protection of the targets is linked with the tasks of safeguarding security, order, and public safety in the area.
- There must be a tight combination between the requirements to protect the targets with the requirements to construct and develop the socio-economic landscape.
+ Responsibilities of agencies, organizations, and individuals in the protection of targets:
- Strictly implement the legal provisions on protecting the targets and other relevant legal regulations; promptly report any violations of the law; participate in and support functional agencies in detecting, preventing, and handling violations of the law regarding the protection of targets.
- Promote the movement of the entire people safeguarding national security; encourage the residents in the area to comply well with the guidelines and policies of the Communist Party of Vietnam, the policies, and laws of the State, actively participate in the fight against crimes and social evils, contributing to maintaining security, order, and public safety in the area where the targets are located.
+ Conditions for determining the targets:
- Type of targets
+ Headquarters of certain central-state agencies and crucial CPV, State agencies in provinces and municipalities;
+ Embassies, Consulates of countries, and representative offices of organizations under the United Nations in Vietnam;
+ Places storing, and preserving documents, assets, and objects of significant value to the State;
+ Places storing special dangerous materials and substances to humans and ecological environments;
+ Places broadcasting to serve the dissemination of the CPV's guidelines and policies, and the State’s laws;
+ Important targets managed by the Ministry of Public Security;
+ Other important targets as decided by the Prime Minister of Vietnam.
- Scale and nature of the targets
+ Targets must have independent and separate headquarters;
+ Targets should have special importance necessitating the protection by armed People's Public Security Forces.
+ Changes and additions to the targets:
- Annually, Ministries, ministerial agencies, agencies attached to the Government of Vietnam, and Provincial People's Committees and municipalities shall review and propose changes and additions to political, economic, diplomatic, scientific-technical, cultural, and social targets defended by armed police sources based on regulations.
- In cases where changes and additions to the targets are necessary, ministries, ministerial agencies, Government of Vietnam affiliated agencies, and People's Committees of provinces and municipalities shall submit the application to the Ministry of Public Security for appraisal and report to the Prime Minister of Vietnam for decision. The application for appraisal includes:
- The application form and accompanying documents identifying the scale and importance of the targets;
- Security and safety assurance requirements for the targets and other documents proving that the targets require protection by armed People's Public Security Forces.
