On May 15, 2014, the Ministry of Justice of Vietnam issued Circular 14/2014/TT-BTP on elaboration of Decree 59/2012/ND-CP on supervision of the law enforcement.
Vietnam: Survey and investigation of law enforcement through seminars and direct interviews (Illustrative image)
Under Circular 14/2014/TT-BTP, the investigation and survey of law enforcement in Vietnam are conducted according to the plan for supervision of law enforcement, when there are difficulties, obstacles, or inadequacies in practical implementation, or at the request of competent state agencies. In such cases, the objectives, supervised subjects, content, locality, time, and methods of the investigation and survey must be determined. The investigation and survey are conducted through seminars and direct interviews as follows:

+ Based on the investigation and survey plan, the hosting agency or unit cooperates with relevant agencies and organizations to organize seminars at the locality under investigation and survey to collect and aggregate information, opinions, and evaluations on the law enforcement and the recommendations and proposals of the participating agencies, organizations, and individuals.
+ T he hosting agency or unit prepares a report on the seminar results.
- Investigation and survey through direct interviews are conducted as follows:
- The hosting agency or unit selects, assigns, and trains interview skills for those conducting the investigation and survey.
- The hosting agency or unit selects interviewees who are knowledgeable about the survey field, impacted persons by the law in the survey field, and persons directly organizing law enforcement in the survey field.
- The interview content focuses on important issues significantly impacting law enforcement in the survey field.
- The investigator must prepare the content and questions to exchange with the interviewee and record fully and honestly the content of the interview.
Note: Based on the processing results of the survey questionnaires, seminar results, and direct interview results, the hosting agency or unit aggregates and prepares a draft survey report. The survey report must include objective assessments of the law enforcement in the field and locality where the investigation and survey are conducted and recommendations for measures to improve the effectiveness of law enforcement and the legal system.
