Vietnam: Summary of legislative documents on elaboration of the organization of air traffic operations

This is an important provision stipulated in Circular 20/2014/TT-BQP issued by the Ministry of National Defense on the promulgation of regulations for management of the operations of the Vietnam Aviation Club, issued on April 29, 2014.

Under Circular 20/2014/TT-BQP, when organizing air traffic operations, operations of all kinds of parachutes, Vietnam Aviation Club must strictly comply with the following regulations in legislative documents:

- National Defense Law; Vietnam Civil Aviation Law; Decree 94/2007/ND-CP dated June 4, 2007, by the Government of Vietnam on managing air traffic operations; Decree 36/2008/ND-CP dated March 28, 2008, by the Government of Vietnam on managing unmanned aircraft and ultra-light flying vehicles.

- Rules for air traffic, management, and operation in the airspace of Vietnam.

- The Civil Aviation Safety Regulations for aircraft and aircraft operation issued under Circular 01/2011/TT-BGTVT dated January 27, 2011, by the Ministry of Transport, and regulations on issuance of diplomas and certificates by the Ministry of Education and Training, and the Ministry of Labor - Invalids and Social Affairs.

- Vietnam Civil Aviation Air Traffic Regulations;

- Aeronautical Information Regulations;

- Flight forecasting and notification regulations;

- Regulations on flying in airport areas.

- Air traffic operations charter, specialized operations charter, and other relevant regulations on flight and parachuting operations.

- Conventions of the International Aeronautic Federation (FAI) when participating in international flight operations.

Additionally, organizations and individuals must not organize air traffic operations or parachute operations without license according to the regulations under Decree 36/2008/ND-CP by the Government of Vietnam.

Organizations and individuals are encouraged to join the Vietnam Aviation Club to jointly develop and organize air traffic operations in accordance with the law.
