Vietnam: Steps to legally grant a postal license

Like other conditional businesses, in order for postal service businesses to be able to operate, enterprises must submit an application for an operating license to the competent state agency to be considered for an operating license according to the correct order and procedures. Depending on each case, this authority belongs to the Ministry of Information and Communications or the Department of Information and Communications.

According to guidance provided in Article 8 of Decree No. 47/2011/NĐ-CP of Vietnam’s Government, steps to carry out the issuance of a postal license include:

Step 1: Submit dossier

Enterprises, organizations requesting for postal license, written confirmation of notification on postal activities shall submit directly or send dossier via post to the postal competent state agencies specified in Article 9 of this Decree and take responsibility for accuracy and honesty of dossier. 

Step 2: Receive dossier

Within 03 working days, after receiving the dossier, the state agency with competence in grant of postal license, written confirmation of notification on postal activities shall send receipt to address of e-mail of enterprises, organizations requesting grant of postal license, written confirmation of notification on postal activities.

If dossier of application for grant of postal license fails to meet the conditions as prescribed, within 07 working days, after receiving dossier, the state agency with competence in grant of postal license, written confirmation of notification on postal activities shall send notification of first time on contents in dossier which need be amended and supplemented. Within 15 working days, from the day of notification, enterprises, organizations shall amend and supplement the dossier as required.

If fail to amend, supplement dossier as prescribed or amending and supplementing is not meet requirement, the state agency with competence in grant of postal license, written confirmation of notification on postal activities shall send notification for the second time within 07 working days since the ending day of time limit of first-time notification. Within 15 working days after the day of notification, enterprises shall amend and supplement dossier as required.

Step 3: Issue postal license

Within 30 days from the date of receipt of a valid application for a postal business license, competent state agencies must verify the application and issue a license to the enterprise if the application meets the prescribed conditions.

In case of refusal to grant a postal license, within that 30-day period, the competent authority must notify the enterprise in writing and clearly state the reason.
