Vietnam: Standards for judicial expertise performers in the monetary and banking sector

On November 16, 2020, the State Bank of Vietnam issued Circular No. 14/2020/TT-NHNN regulating judicial expertise in the field of currency and banking.

Article 5 of Circular 14/2020/TT-NHNN stipulates the standards for judicial expertise performers, and ad hoc judicial expertise performers in the monetary and banking sector as follows:

1. Vietnamese citizens residing in Vietnam who meet the following criteria may be considered for appointment as judicial expertise performers:

  • Standards as specified in point a, clause 1, Article 7 of the Law on Judicial Expertise and not under the cases stipulated in clause 2, Article 7 of the Law on Judicial Expertise;
  • Possessing a university degree or higher in one of the majors: finance-banking; accounting; economics; law; information technology, fine arts, printing engineering and chemical technology, awarded by Vietnamese educational institutions according to legal regulations, or by foreign educational institutions and recognized for use in Vietnam;
  • Having at least 5 years of professional experience in the trained field calculated from the date of appointment to the positions of officials, public employees or from the date of signing employment contracts, suitable with the field the individual is appointed as a judicial expertise performer.

2. Vietnamese citizens residing in Vietnam who meet the criteria specified in clause 1 of this article can be selected as ad hoc judicial expertise performers.

In cases where an individual does not hold a university degree but has received specialized training in the fields mentioned in Article 3 of this Circular and has at least 5 years of practical experience in that field, they can be selected as ad hoc judicial expertise performers.
